Terms of Service

This document sets the guidelines and limitations of using Sunsethue’s services. By using Sunsethue or any of its services, you agree to abide by the terms outlined in this document. Your continued use implies your understanding and acceptance of these conditions.

The brand Sunsethue is owned and operated by Tropoflow, a registered company in Belgium.

User rights and responsibilities

Users are expected to engage in respectful and lawful behavior on our platform. Violations may lead to consequences as outlined later in this document. Sunsethue is not liable for any decisions, or consequences of those decisions, made using data that our service provides.

Users are responsible for maintaining the security of their accounts and passwords. Sunsethue is not liable for any misuse as a result of insufficient protection of account credentials.

Service description

Sunsethue provides the following main services:

1. Sunsethue: sunrise and sunset forecasts open to anyone with or without account
2. Sunsethue Alerts: sunrise and sunset notifications using email for users with an account, also consisting of a payed Premium option
3. Sunsethue API: gateway to Sunsethue data in form of a REST API, only available to users with an account

Lifetime access: a single purchase of Sunsethue Alerts Premium will give lifetime access to the service. "Lifetime access" refers to access to the purchased product or service for as long as Sunsethue is operational and continues to offer the product or service. Sunsethue reserves the right to discontinue the product, service, or the website at any time, for any reason, without prior notice. In such cases, "lifetime access" will no longer apply, and no refunds will be provided unless otherwise stated.

We reserve the right to modify or discontinue services for improvement. Users will be notified of significant changes.

Use of Sunsethue data

The data generated by Sunsethue can only be used for personal use, this data should always be accompanied by a reference to Sunsethue (eg. link, name or logo). Sharing this data (eg. on social media) is allowed under the same condition, and only so for non-commercial purposes.

Gathering the data should solely be done through human interaction with the Sunsethue website, or using the Sunsethue API. Any attempt at automation or scraping Sunsethue for data will be restricted immediately.

The commercial use of Sunsethue data is currently restricted for all users, except users that use the pay-as-you-go API plan.

Payment terms

Users agree to pay the specified fees for our services. Payments include single one-off payments, subscriptions and pay-as-you-go models. Payments are managed through Stripe. None of Sunsethue’s products or services include refunds.

For the lifetime access of Sunsethue Alerts Premium, please refer to the “service description” section. In the case of shutdown of the service, no refunds will be granted.

Intellectual property rights

Sunsethue retains ownership of all intellectual property, this includes the design of our website and services (including the ray-based model) following EU intellectual property rights laws. Infringement on IP or copyright laws will be reported to the competent authorities.

Termination and suspension

We may terminate accounts for infringing upon any of the conditions outlined in this document. Termination of accounts includes the termination of API keys and Sunsethue Alerts accounts. No refund will be provided in these cases.
